These terms govern the provision of services by Winnilinks Logistics Limited and the use of this website. By instructing us or by using this site, you accept them.
1. Definitions
“We”, “us” and “Winnilinks” means Winnilinks Logistics Limited. “You” and “Client” means the person or entity instructing us. “Goods” means any cargo, consignment, parcel or item handled by us. “Services” means freight forwarding, courier, customs clearance, warehousing, distribution, fulfilment and security services.
2. Scope of services
We act as a freight forwarder, customs agent, warehouse operator and security systems provider as applicable to the instruction given. Where we act as agent rather than principal, we contract with carriers and third parties on your behalf.
3. Quotations
- Quotations are based on the information you supply — weight, volume, cargo description, origin and destination.
- Rates are valid for the period stated on the quotation and are subject to carrier surcharges, fuel adjustments and currency movements.
- Where actual weight, volume or cargo description differs from what was declared, the rate will be adjusted accordingly.
- Duty, VAT, port charges, demurrage, storage and statutory fees are payable by you unless expressly quoted as included.
4. Your obligations
- Provide accurate, complete and timely documentation, including commercial invoices, packing lists and any permits.
- Ensure Goods are properly packed, labelled and fit for the transport mode booked.
- Declare dangerous, hazardous, perishable, high-value or restricted Goods before booking.
- Ensure the Goods are lawful to export from the origin country and to import into the destination country.
- Hold appropriate cargo insurance. Insurance is arranged only on your express written instruction.
5. Prohibited goods
We will not knowingly handle narcotics, counterfeit goods, ivory or wildlife trophies, weapons or ammunition, currency, undeclared dangerous goods, or anything prohibited by Kenyan law or the law of the destination country. We may refuse or abandon any consignment found to contain such items and report it to the authorities.
6. Payment
- Charges are payable on the terms stated on the invoice or quotation.
- Duty, taxes and disbursements advanced on your behalf are recoverable in full.
- We may exercise a general lien over Goods in our possession for unpaid sums.
- Overdue accounts may attract interest and may result in suspension of services.
7. Transit times
Transit times are estimates given in good faith. They are affected by carrier schedules, customs processing, port congestion, weather and regulatory action. We do not guarantee a specific arrival date unless we have agreed one in writing.
8. Liability
- Our liability for loss of or damage to Goods is limited to the amount recoverable from the carrier or, where applicable, to the limits set by the governing international convention.
- We are not liable for indirect or consequential loss, including loss of profit, market or business opportunity.
- We are not liable for delay, loss or damage caused by inaccurate or incomplete documentation supplied by you, inherent vice of the Goods, inadequate packing, or any event beyond our reasonable control.
- Claims must be notified in writing within seven (7) days of delivery, or of the date delivery should have occurred.
9. Warehousing
Goods are stored at the rates and for the period agreed. Storage charges continue until Goods are collected. We may dispose of Goods left uncollected and unpaid for after reasonable written notice, applying proceeds to outstanding charges.
10. Security services
Equipment supplied carries the manufacturer's warranty. Installation workmanship is warranted for the period stated in the project agreement. Warranties do not cover damage from misuse, unauthorised modification, power surges or acts of God. Surveillance systems assist security — they do not guarantee prevention of loss, and we are not liable for incidents occurring on monitored premises.
11. Force majeure
Neither party is liable for failure to perform caused by events beyond reasonable control, including natural disaster, war, civil unrest, epidemic, strike, port closure, government action or carrier failure.

13. Governing law
These terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have exclusive jurisdiction.
